("we", "us"), 1007 Main St, Sumner, WA 98390. By using the service or paying for it you agree to these Terms. If you do not agree, do not use the service. ## 1. What the service does You provide flight records (dates, flight numbers, and airports). We look each flight up in third-party historical flight data, currently FlightAware AeroAPI, and return the information we find, such as aircraft registration (tail number), aircraft type, ICAO airport codes, and block times. The service is a research and record-keeping aid. It is not an official record, not a substitute for your own logbook, and not certified by any airline or aviation authority. ## 2. Your data and your responsibility - You are responsible for providing usable, accurate data. Each flight needs a date, a flight number, and, for a reliable match, the departure and arrival airports. Before you pay, we show you exactly which flights we read from your file and which lines we set aside; it is your responsibility to review that list and correct it. - You are responsible for the accuracy and regulatory compliance of your own logbook. Verify our results against your own records before relying on them for an interview, an audit, a certificate application, or any regulatory purpose. - You represent that you have the right to submit the data you upload and that it does not contain information you are not permitted to share. ## 3. Fees, what counts as a flight, and no refunds - The one-time catch-up fee covers up to the number of flights stated at checkout; additional flights are charged at the per-flight rate shown. The monthly plan includes the number of new flights per month stated at checkout; additional flights are charged at the per-flight rate and added to your next invoice. - A flight counts when we send it to the flight-data provider, whether or not a match is found. We pay for every lookup, so lookups that return "not found", "ambiguous", or partial information are still charged. Lines we set aside before payment (totals, duplicates, aircraft-type lines) are never charged. - **All sales are final. We do not offer refunds**, including for flights that are not found, for data you entered incorrectly, or for records the provider does not have. Instead, we provide one correction pass, described in Section 4. - Subscription charges recur monthly until you cancel. Cancelling stops future charges; charges already made are not refunded. You can cancel from your billing page at any time. - Prices may change; the price shown at checkout is the price you pay for that purchase. ## 4. One correction pass After your results are delivered, you may correct flights that came back not found or ambiguous and re-check them at no additional charge: choosing between candidate aircraft, accepting the route the provider recorded, or editing the date, flight number, or airports of an entry. Re-checks that change a date or flight number are limited per flight, currently three, and we may set a reasonable time limit on corrections. This correction pass is the remedy for lookups that do not match; it is provided in place of refunds. ## 5. Accuracy and third-party data Results depend on data from third parties that we do not control. Historical records may be incomplete, delayed, or wrong, and some operations (ferry flights, some charter and private flights, flights before the provider's coverage began) are not available. We may show more than one possible aircraft when the data is ambiguous. We do not guarantee that any flight will be found or that any result is correct. ## 6. Accounts and access One-time purchases are delivered at a private link sent to your email; keep it private. Monthly plans use email sign-in links; you are responsible for the security of that email account. We may suspend or terminate access for abuse, fraud, or violation of these Terms. ## 7. Acceptable use Do not use the service to look up flights you did not operate or are not otherwise entitled to research, to scrape or resell flight data, to overload the service, or in violation of any law or the terms of our data providers. ## 8. Intellectual property You keep all rights to the data you upload. You grant us a licence to store and process it to provide the service, including keeping your records so your results link keeps working. The service, its software, and its design belong to Valor Thread Company, Inc.. Flight data is provided under licence from its providers. ## 9. Disclaimer of warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE COMPLETE, ACCURATE, OR ACCEPTED BY ANY EMPLOYER, AUDITOR, OR AUTHORITY. ## 10. Limitation of liability TO THE FULLEST EXTENT PERMITTED BY LAW, VALOR THREAD COMPANY, INC. AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF DATA, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the smallest amount permitted by law. ## 11. Indemnification You will defend and indemnify Valor Thread Company, Inc. against claims, losses, and expenses (including reasonable legal fees) arising from your data, your use of the results, or your breach of these Terms. ## 12. Governing law and disputes These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Pierce County, Washington, and you consent to their jurisdiction. Before filing a claim, contact us at hello@logbookfix.com; most issues can be resolved directly. ## 13. Changes We may update these Terms. The date at the top shows the current version. Continued use after a change means you accept the updated Terms. Material changes to pricing apply only to purchases made after the change. ## 14.
